The following Terms of Service and End-User License Agreement represent an agreement between you and Cool Cursors Inc. and its direct and indirect parent, affiliate, and subsidiary companies (collectively, "Cool Cursors Inc.", "we", "us" or "our"). Access or use of the website and/or service for which you seek registration constitutes acceptance of our End-User License Agreement. Changes will immediately become effective upon posting the revised Terms of Service and End-User License Agreement on our website. If you do not wish to accept the amended agreement, you must cancel your access to Cool Cursors products. Continued use of Cool Cursors Products accessed through the website in your personal account constitutes your acceptance of the terms of the modified agreement.
You must be at least 13 years of age to access or use the Cool Cursors Products. If you are not 13-years-old, please have your parent or legal guardian install the Cool Cursors Products after they have reviewed and discussed this agreement with you.
Subject to this End-User License Agreement and its terms and conditions, Cool Cursors Inc. hereby grants you a limited, nonexclusive, non-trasferable, non-sublicensable, and revocable license to access and use the Cool Cursors Products as provided by Cool Cursors Inc. The Cool Cursors Products and the related updates are solely for your personal, non-commercial, and lawful use in the manner permitted by this agreement.
You may not transfer, reproduce, lease, or sell Cool Cursors Products to a third party such as others in a company, university, or organization.
Cool Cursors Inc. may provide links to third party services and/or the third party services may be made available to you via Cool Cursors Products. If you install or download third party services, feeds, and/or content you are subject to such third party's terms of services and privacy policies, which can be accessed through the third party's website.
Cool Cursors INC. MAKES NO REPRESENTATION OR WARRANTIES WITH RESPECT TO THE WEBSITE. THE WEBSITE AND ALL INFORMATION, CONTENT, MATERIALS, AND SOFTWARE ARE PROVIDED TO YOU "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, Cool Cursors INC. DISCLAIMS ALL WARRANTIES AND CONDITIONS, LEGAL, EXPRESSED OR IMPLIED, BY OPERATION OF LAW OR OTHERWISE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Cool Cursors INC. AND ITS AFFILIATES AND SUBSIDIARIES SHALL NOT BE LIABLE FOR LOSS OF OR DAMAGE TO PROPERTY, LOSS OF DATA, LOSS OF INCOME, FAILURE OF PERFORMANCE, AND GOODWILL.
To the fullest extent permitted by law, you agree to defend and hold harmless Cool Cursors Inc. and the Cool Cursors Inc. related parties from and against any and all claims, losses, charges, costs, and liability that may arise from your use of Cool Cursors Products.
Cool Cursors Inc. reserves the right to suspend your access to all or any part of the website or the use of Cool Cursors Products at any time for any conduct that Cool Cursors Inc. believes is a violation of this agreement or use that is harmful to other end-users. You may terminate this End-User License Agreement at any time by noticing Cool Cursors Inc. of your decision to terminate.
You agree to the terms of our Privacy Policy regarding the Cool Cursors Products and its associated services, websites, and features. Our Privacy Policy describes the practices concerning the information processed by Cool Cursors Inc. and its affiliated companies.
By accepting this agreement, you acknowledge and accept full responsibility for the security risks of Cool Cursors Products. Cool Cursors Products may be exposed to various security issues through misuse, unauthorized access, corruption, and interception and should be considered insecure.
All intellectual property rights including without limitation all software, protocols, content, documentation are owned by Cool Cursors Inc. Therefore, you must regard the Cool Cursors Products like any other material protected by laws relating to property rights and in accordance with this agreement.
The End-User License Agreement constitutes the complete agreement between Cool Cursors Inc. and you with respect to the website and Cool Cursors Products. This agreement will be governed by the laws of Hong Kong.
